AIBE compulsary to clear for enrolment as an advocate

  

BCI decided to grant 6 months window to law graduates to quit their jobs not connected with law

High Court of Gujrat in the above matter allowed persons with other employments,whether full or part time to enrol as Advocate without resigning from their job . BCI filed an appeal against this order before the Hon’ble Supreme Court

In the affidavit filed by BCI said  before the Supreme court :

“If a person remains in service having no connection /relationship with legal or judicial matters ,then in that case such candidate shall be required to clear the AIBE(ALL INDIA BAR EXAM )again if he /she decides to get her/his license revived after remaning in the job for more than 5 years from the date of publication of her/his result of AIBE “

The above condition   is not applicable to the candidates joining Public Prosector or APP or some judicial service or some service like Law officers in some corporate or Government offices,they are treated on ‘different footing’ 

SC while dealing with this case directed BCI to consider some balancing view and honouring the direction BCI held a meeting on 8th July and passed a resolution that difficulty of such candidates who are apprehensive of loosing  their job even before appearing in AIBE due to the requirement of resignation from current job can be well understood . BCI decided to grant 6 months window to law graduates to quit their jobs after declaration of result of All India Bar Examination for enrolment as an advocate
